50 million blinds recalled as strangulation hazard

WASHINGTON -- The government and the window covering industry on Tuesday recalled more than 50 million Roman-style shades and roll-up blinds because of the risk children may be strangled by the cords. The Consumer Product Safety Commission said five deaths and 16 near-strangulations from Roman shades have been reported since 2006, while three deaths connected to roll-up blinds have been reported since 2001. Roman shades can become dangerous, the CPSC said, if a child's neck gets stuck between the exposed inner cord and the fabric on the backside of the blind, or if the cord gets wrapped around a child's neck.

Lawyer alleges Mercury Insurance Company Recruited Witness to Give False Testimony

In a twist straight out of a John Grisham novel, a lawyer whose client received $1.37 million in damages in a traffic crash case is asking for an additional $500,000 from the insurance company, alleging the firm fabricated a witness' testimony, gave her the facts of the case to favor their case, and may have even bribed her.

It is alleged that Mercury Insurance Co. called an "eyewitness" to testify at the trial. The witness testified at the trial earlier this month that she saw the accident from her apartment and Kirk was swerving, driving drunk and speeding, but a signed lease showed the witness didn't move into the apartment until six months after the accident. The witness was spoon-fed her 'facts' of the case through Mercury agents," Kolker wrote in a court pleading. Those 'facts' included the date and time of the accident, types of vehicles involved and direction of vehicles' travel. The only possible way (the witness) came to know these facts was from Mercury's agents. She had no firsthand knowledge of the facts.  The witness was disclosed three weeks before trial. "Plaintiff has reason to suspect that Mercury offered bribes to get people to testify at trial," Kirk was on a motorcycle and admitted that he was under the influence of alcohol when he was hit by a truck driven by Enver Hamiti, of Wood River, at Ridge and Fifth streets in Alton on June 30, 2006. Kirk alleged Hamiti did not stop to help him, though his leg was detached during the accident. A passer-by ripped a diamond earring from Kirk's ear as he lay on the pavement.

"This is just one example of how important it is for an injured party to be represented by an attorney when someone has caused their injury.  The insurance companies have only one interest in mind and that is their own bottom line.  What many individuals do not realize is that many insurance companies pay their adjusters a bonus for the more money they save the company in resolving injury claims." said Todd Mathews.  "If you have been injured and spoken with the insurance adjuster it is certain you have been instructed that you do not need an attorney and they want to take a recorded statement.  Insurance companies know that on average once an attorney gets involved the settlements for the injured party increases significantly and in fact that injured party gets more in their pocket than they would have received had they not retained an attorney.  This is even after the attorney fee is paid."

The Mathews Law Firm is dedicated to serving individuals throughout Missouri who have been injured due to another person's recklessness or wrongdoing. Our firm is committed to providing our clients with superior legal counsel and exceptional client service, always treating their particular needs with the greatest importance.  When we take on a case, we have two primary goals: to bring our clients much-needed peace of mind, and to recover the greatest amount of financial compensation possible. At The Mathews Law Firm, we are committed to helping accident victims and their families rebuild their lives and face brighter futures.

Being injured in any type of accident or because of negligence or malpractice on the part of another person can leave the victim feeling helpless. Physical and emotional trauma often result from incidents of this kind, and having to then deal with legal matters and financial difficulties can make an already tough situation almost unbearable. This is why it is so important to involve a personal injury lawyer.

A lawyer can take over, filing your insurance claim and dealing with all parties involved in the case in order to allow you to focus on recovery and spending time with friends and family members. While an insurance company may try to pull the wool over your eyes and offer you a settlement which is far below the true value of your claim, if you have a personal injury lawyer on your side the insurance company will think twice. In all, a competent legal professional can maximize the value of your legal claim.
